This is a will contest. Issues were made and trial was had. At the close of all the evidence proponents moved that the jury be instructed to return a verdict in favor of proponents and to find that the will offered in evidence was the last will and testament of the deceased. The court overruled the motion and submitted the issues to the jury. The jury did not agree upon a verdict and was discharged. Thereupon the proponents moved for judgment in accordance with their motion for a directed verdict. The court overruled the motion. The proponents appeal from that order. We reverse the judgment…
