The reply denying the allegations of the plea in abatement raised an issue of fact, which the record states was decided in favor of the defendant. But the record further shows that the proceeding, which the plaintiff claims is an application to the Superior Court under § 3860 of the General Statutes, was dated the 11th of March, 1899, and served upon the defendant town upon the 15th of that month, and that the date of the adverse action of the board of relief was February 4th, 1899.
