Warner, the plaintiff, brought action against Intlehouse, the defendant, alleging in his complaint that he was the owner of a certain described tract of land in Sargent county; that on divers days between the 15th day of September and the 15th day of November, 1928, the defendant continually trespassed upon the plaintiff’s land and without the latter’s consent tore up and removed from the land certain fencing, converting and appropriating the same to his own use; that the plaintiff had demanded of the defendant the return and replacing of the same or payment therefor and the defendant had…
