This is an insurance coverage dispute. Plaintiffs Brown & Root Braun, Inc. (“B & R”) brought suit in the District Court against defendant Home Insurance Co. (“Home”) seeking indemnification for sums they had paid for personal injuries sustained by twelve individuals arising from a sludge storage tank explosion. Sun, the owner of the refinery where the explosion occurred, had contracted with B & R to act as the principal contractor for the project.
