MILLIKEN, Justice.

This is an'appeal from a judgment of the Perry Circuit Court setting aside an order of the Workmen’s Compensation Board denying compensation. The referee of the Board dismissed the claim of appellee, Cecil Childers, holding that the appellant, Columbus Mining Company, hereinafter referred to as the “Company”, had not received due and timely notice of the accident and injury for which compensation was sought.
