MEMORANDUM
GESELL, District Judge.
This action was brought by a discharged postal worker, Joseph Gordon, and his union seeking reinstatement, back pay and other relief on grounds that the discharge violated the contract between the union and the Postal Service and also violated the First Amendment rights of Gordon and his union. The ease is before the Court on defendant’s second motion for summary judgment and plaintiff’s cross-motion for partial summary judgment, which have been fully briefed by the parties.
