delivered the opinion oe the court:

The appellee, Gaines, sold and conveyed to the appellant, Yowell, of Boone county, Kentucky, one hundred and ninety-six acres of land in that county, reserving a lien as security for the payment of the consideration of sixty-five dollars an acre, payable in several installments.

In March, 1862, a portion of the price having been then paid, and about eight thousand dollars unpaid, of which only about one thousand dollars had become due, the appellee brought a suit in equity for enforcing payment of the sum so due and unpaid, and obtained a…
