Respondent, Wilfred E. Marrin, was admitted to the practice of law in New York by the First Judicial Department on July 8, 1971. At all times pertinent to this proceeding respon*240dent has maintained an office for the practice of law within the First Judicial Department.

On or about March 1, 1994, respondent was served with a notice and statement of charges.
