Alma Spencer obtained a verdict and judgment against James Gordon in an action of slander. During the progress of the cause the-defendant, now the appellant, took two bills of exceptions, and has appealed to this Court for a reversal of the judgment.

The first bill of exceptions states, that the defendant applied to the Circuit Court for a continuance of the cause, on account of the absence of four witnesses; stating in an affidavit that one-of them, who resided in this state, had been subpoenaed in his behalf, as he was informed by the sheriff; that the other three lived in the state of Ohio,…
