This matter was referred to Special Term Part II for a traverse hearing concerning service of the summons and complaint and final determination of defendant’s motion to dismiss the complaint and plaintiff’s cross motion for sanctions.

The traverse hearing was held on March 6, 2000. Both parties were represented by counsel. The process server, Stephen Greenstein, testified that on September 24, 1999, he personally served the defendant, Jeffrey Ben Zvi, at his home address with a copy of the summons and complaint in this matter.
