On September 26, 2005, 23-year-old Brian Lackhouse was fatally injured when he and his bicycle fell off a retaining wall adjacent to the parking lot of a Fannin County shopping center. Lackhouse’s mother and sister, Brenda Barnes and Amanda Eavenson (the plaintiffs), brought this wrongful death action against Morganton Baptist Association, Inc., William T.
