The parties hereto appear in this court in the same order as in the trial court and reference will be made to them herein as plaintiff and defendant. Defendant is a minor and appeared by his next friend.
Plaintiff on May 14,1937, sold an automobile to defendant who at the time was an infant of the age of nineteen years and seven months. There is nothing in the record from which it appears that plaintiff had any knowledge of defendant’s infancy. The purchase price of the car was $627.86 including the sales tax.
