The defendant was indicted for an assault with a dangerous weapon, to wit, a knife. The case was tried in the Superior Court and resulted in a verdict of guilty with recommendation of mercy. The defendant filed his motion for a new trial, which motion was heard and denied by the justice of the Superior Court who presided at said trial.
