The defendant is charged with setting fire to and burning an outhouse belonging to Charles Gerock, in an indictment containing four counts,-in two of which it'is simply described as an outhouse, and in the others with the superadded words, “used as a kitchen..” The counts omit to aver the “intent thereby to injure or defraud,” which is an essential ingredient in the'offence created under paragraph 6, of §985, of The Code, but which are rendered unnecessary ,by the amendment of 1885, ch..66, which strikes out those words.
