The solitary ground upon which it is claimed that the defendant was liable in damages for the plaintiff’s injury, is that the defendant was guilty of negligence in employing a fellow servant by whose negligence the injury was occasioned. This makes it necessary to inquire for a moment what is the law in regard to *231this kind of liability. The rale of law on that subject is very clear and altogether unquestioned.
