Appeal from Mitchell District Court. — Hon. G-. W* Ruddick, Judge. Action to recover an amount alleged to be due on a promissory note. There was a trial by jury, and a verdict and judgment in favor of the defendant. The plaintiff appeals.

The note in suit was given by the defendant on the seventh day of December, 1883, for the sum of sis hundred and ten dollars, with interest thereon at seven per cent, per annum. It was made payable to Seth P. French, and was by him assigned to the plaintiff. J. W. French, the husband of the defendant, died in June, 1877, possessed of notes and mortgages of the value of six thousand dollars or more. Administration of his estate was not granted, but the defendant took possession of the property, and apparently retained it for her own benefit. When the note in suit was given, Seth P. French, who…
