DUFRESNE, Justice.

On appeal. By grand-jury indictment dated May 9, 1968 the defendant was charged under 17 M.R.S.A. § 201 with the crime of assault and battery in that he, the said Robert P. Wheeler, of South Berwick, in the County of York and State of Maine, on the twenty-fourth day of April, 1968, at said South Berwick, on one Richard Landry, feloniously did make an assault, and him, the said Richard Landry, then and there feloniously did strike, beat, bruise, wound and ill treat.
