LATTIMORE, Judge.
— Appellant Appellant was convicted in the District Court of Smith County of murder, and his punishment fixed at death.
Appellant was convicted for billing his mother. There is no denial of the fact that he shot her and that from such shooting she died. Deceased was the mother of ten children, among whom was appellant, and it is made to appear from the record that she had never been married.
