On J anuary 9, 1892, Conro & Son, defendants in error, wholesale lumber dealers of Rhinelander, Wisconsin, under a written contract, sold to the Bine Valley Lumber Company of Omaha, plaintiff in error, abont 6,000,000 feet of pine Timber in the rough, at the agreed price of $12 p.er thousand feet; abont 900,000 feet of an inferior *41grade, and about 85,000 feet of culls for $4.50 per thousand feet.
