The bill of complaint herein brought by the city in effect alleges that in 1914 the city by ordinance made a contract by which the city granted to the predecessors of the utility company, “and its successors and assigns, the right and privilege to construct, own, operate and maintain in the City of Palatka, Florida, a plant or plants for the manufacture, sale and distribution of electricity, gas and other i'lluminants or products for light, *588power and fuel; and to lay mains, pipes and fixtures under the streets, lanes, alleys, sidewalks and bridges of said city for the distribution of gas, and…
