Appellant, Bernard Nettles Brown, a former County Commissioner of Bowie County, Texas, was tried by a jury and found guilty of four counts of extortion under color of official right (18 U.S.C. § 1951), two counts of conspiracy (18 U.S.C. § 371) and thirty-two counts of mail fraud (18 U.S.C. § 1341). Brown was sentenced to three years imprisonment on Count I. On the remainder of the counts, Brown’s sentence was suspended and he was placed on five years probation to be commenced after the sentence on Count I was completed.
