GOODWYN, Justice.
This is the second appeal in this case. The first appeal (Petcher v. Rounsaville, 267 Ala. 237, 101 So.2d 324) was brought by Petcher from a decree overruling his demurrer to the bill. We reversed and remanded. On remandment, the bill was amended and Petcher’s demurrer thereto was overruled. The present appeal is from that decree.
