The defendant (Eberhart), as the result of competitive bidding, was awarded a contract for the construction of an oil mill, in the city of Memphis, for the Perkins Oil Co. The contract price for the work was $26,000. Eberhart, the contractor, executed a bond with the American Bonding & Trust Co., as surety, in the penalty of $7,000, for the faithful performance of the work. Toward the close of the work complications arose.
