CROAKE, District Judge.
In this action the plaintiff, Lawrence Bernardo, seeks to recover damages from his employer, Bethlehem Steel Company, the defendant, for injuries resulting from an accident which occurred when he was engaged in doing welding work on a floating drydock owned by the defendant.
The complaint asserts two causes of action. In the first cause of action, plaintiff alleges that defendant has been negligent in not providing a reasonably safe place to work, and that in so doing has violated Section 240 of the New York State Labor Law, McKinney’s Consol.
