Appeal from District Court, Travis County; George Calhoun, Judge. Suit by the State of Texas and another against the Gulf Production Company and others. Judgment for plaintiffs, and defendants appeal.

The land in dispute is valued in the pleadings at $8,000,000. Up to the 1st day of June, 1920, the last day to which an accounting is shown in the record, petroleum oil of the cash value, including interest to said date, of $737,479.04, had been produced from the land. The expense incurred in producing the oil was $420,068.36, which was deducted in the judgment from the gross proceeds. The state of Texas obtained judgment for $92,184.88, and P. K. Shuler for $225,225.-80, being the net balance after deducting the cost of production, and for improvements, placed on the land by the company…
