Frank Garon and Alex Chutz were charged in a bill of information with willfully and feloniously breaking and entering a shop in the nighttime, with intent to steal. They were tried. A verdict of “guilty as charged” was rendered, and the accused were sentenced to not less than eighteen months nor more than two years in the parish jail. From the verdict and sentence both defendants appealed. In 1925 the accused appealed to this court from a conviction and sentence for breaking and entering a garage in the nighttime with intent to steal and rob.
