This is an appeal of a case that began as a suit filed by the City of Irving (“the City”), appellee, against then-Attorney General Jim Mattox 1 and appellant William C. Dear, seeking a declaratory judgment regarding the City’s right to refuse production of certain records under the Texas Open Records Act. Dear filed a counterclaim against the City and a third-party action against appellee Benny Newman, the Chief of Police for the City.
