Affirming.

The appellants, W. B., E. R. and W. O. Womack are brothers, and they owned the timber on a tract of land in Greenup County. The appellee, Stephen A. Douglas, was a real estate broker. Claiming that under a contract with the Womacks he was to receive as compensation for his services in selling the timber all that he could sell it for over ten thousand dollars, he brought this suit against them to recover three thousand dollars, upon the ground that after making the contract he sold the timber for thirteen thousand dollars when they refused to…
