This suit was brought by appellant, Charles E. Sutton, against the appel-lees, Wright & Sanders, in the district court of Bexar county, Tex., Seventy-Third judicial district, for $7,500 damages ■ alleged to have been sustained by reason of the breach of a contract. The plaintiff alleged that on or about the 17th of November, 1919, the defendants entered into an agreement with plaintiff whereby they agreed and bound themselves to purchase from him 100,000 cubic yards of gravel for the sum of 12% cents per cubic yard, and he agreed to sell the gravel to them at that price;, said gravel to be…
