This action was brought in justice’s court by Hill, the appellee here, against Peter and Piper, the appellants, upon an appeal bond, made by the latter to the former, in the penalty of two hundred dollars. The case was taken to the superior court, by appeal, and there tried before the court and a jury, resulting in a verdict and judgment for plaintiff for debt two hundred dollars, and damages one hundred and thirty-eight dollars and thirty-five cents, the debt to be discharged on the payment of the damages.
