The petitioner Kirt Wainwright was found guilty by a jury of capital felony murder in 1989 and sentenced to death by lethal injection. This court affirmed. Wainwright v. State, 302 Ark. 371, 790 S.W.2d 420 (1990); cert. den__U.S. _, 111 S. Ct. 1123 (1991). Petitioner now seeks permission to proceed in circuit court pursuant to Criminal Procedure Rule 37.
