GARRECHT, Circuit Judge.
Richard C. Franzeen appeals from an order of the District Court denying his petition for a writ of habeas corpus. February 18, 1936, he and one Elliott W. Michener were sentenced and judgment entered under an indictment returned in the Northern District .of California, drawn in five counts, which charged him and his co-defendant with violation of Section 264 of 18 U.S.C.A. He had pleaded guilty and received a sentence of five years on each count, terms of imprisonment to run concurrently; he also was fined the sum of $1 on each count. He was imprisoned at McNeil…
