This is an action in contract in which the plaintiff shipper seeks to recover for damage to leather goods which allegedly resulted from the defendant’s failure to make delivery of these goods to a consignee in California.

The case was submitted to the trial court upon a statement of agreed facts. Said facts may be summarized a follows: On November 13, 1979, the plaintiff caused one carton and two bundles of cattle hides to be delivered to the defendant for eventual shipment to California.
