RAMSEY, Judge.
This is a companion case to that of Fazina v. State, which is reported in 100 S. W. Rep., 394. The homicide on which this charge of murder was based grew out of the same facts as are set forth at some length in the opinion of the court in the Fazina case, though the evidence is far from, being identical, and there were some issues raised and some testimony introduced in this case that does not appear in the Fazina case.
