Petition of James Ryan for a writ of habeas corpus.

The petitioner was found guilty of vagrancy, and sentenced to the county jail by a justice of the peace of Anaconda Township, in Deer Lodge county. The acts constituting the offense were all committed within the limits of the incorporated City of Anaconda. Because of this fact, it is claimed that said justice had no jurisdiction of the offense.
Prior to the presentation of the proposed Codes of 1895 for adoption by the legislature of the state, the magistrate of a city and a justice of the peace of the same township had concurrent jurisdiction of misdemeanors committed within the limits of the…
