Inmate Johnny Hogue filed a habeas corpus petition challenging discipline imposed in absentia for violations of prison regulations. We granted Hogue’s petition for review of the Court of Appeals’ decision affirming the district court’s summary denial of his petition. On review we consider the issues of: (1) whether Hogue’s procedural due process rights were denied when the disciplinary hearing was conducted without Hogue present; (2) whether Hogue was denied due process when the hearing officer ordered disciplinary segregation for 46 days rather than…
