Arthur Sullivan, as plaintiff, sued the St. Louis & San Francisco Railway Company in the court of common pleas of Sedgwick county, alleging that his crops on the northwest quarter of section 28, township 25, range 1 east, in Sedgwick county, had been damaged in the years 1890 and 1891 by the wrongful acts of defendant company in cutting down and destroying the banks and levees of a natural watercourse known as the middle branch of Chisholm creek, in close proximity to plaintiff's land on the south, and also in cutting down and destroying a…
