Joseelyn Johnson, individually and as the special administrator of the estate of Nakia Marie-Amore Burress, deceased, filed this lawsuit under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b), 2671-80, alleging medical malpractice during the delivery of her baby, Nakia. Johnson alleges that Dr. Emanuel Javate breached the standard of care in four ways and that one or more of the breaches proximately caused the death of her baby.
