OPINION OF THE COURT

BICKLÉY, J.

The appellants, J. Houston and John Houston, were convicted of assault with intent to murder D. D. 'Dodson. The Floustons lived on a farm in Curry county. Dodson was a deputy sheriff of said county. There had been strong language used between Dodson and the elder Houston. There were charges and counter charges between the parties, and it is enough to say that an ill feeling existed between them prior to any physical demonstration.
