Appeal by the defendant, the Erie Railroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Orange on the 18th day of February, 1907, upon the verdict of a jury for $16,500, and also from an order entered in said clerk’s office on the ¿1st day of February, 1907, denying the defendant’s motion for a new trial made upon the minutes.

Woodward, J.:

The action is for negligence on the part of the defendant, resulting in the death of the plaintiff’s intestate, and has resulted in a Verdict for the plaintiff. Appeal comes to this court from the *298judgment and from an order denying a motion for a new trial on the minutes.

Plaintiff’s intestate was a railroad engineer. He had brought a passenger train from Jersey City to Port Jervis. At this point he detached his engine from the trajn, ran down the main track for a considerable distance and turned in on a siding, backing his engine down and upon a second siding running parallel…
