Official Referee. This is an action instituted by the plaintiff to recover the sum of $774.40, being one half of two bank accounts standing in the names of the parties payable to either or the survivor, alleged to have been wrongfully converted by the defendant to his own use.,

The parties to this action were united in marriage in 1885, the plaintiff at the time of the trial being seventy-nine and the defendant eighty-one years of age.
