SHAW, District Judge.
This matter is before the Court pursuant to the Report and Recommendation of United States Magistrate Judge Thomas C. Mummert, III, filed September 26, 1997. See 28 U.S.C. § 636(b). Magistrate Judge Mummert recommends that the Court deny Plaintiffs Motion for Summary Judgment and grant Defendant’s Motion for Summary Judgment. Neither party has filed an objection to the recommendation.
