Plaintiff commenced this action seeking equitable relief to protect his purported right to damages under a loan agreement (“funding agreement”) by filing a complaint in equity in the Court of Common Pleas of Allegheny County, Pennsylvania, on December 30, 2005. Defendants removed the action on January 12, 2006. Presently before the court are defendants’ motion to dismiss, stay or transfer the action and plaintiffs motion for a temporary restraining order.
