— Affirming.
This is an appeal from a judgment of tbe Franklin circuit court, entered pursuant to tbe verdict of tbe jury in tbe sum of $6,200 in favor of Howell P. Scott against tbe appellant, Hermitage Land & Timber Company. Pending tbe appeal, Mr. Scott died, and. the appeal has' been revived against his executrices.
