ORDER GRANTING DEFENDANTS’ MOTION TO DISMISS
HOVLAND, Chief Judge.
Before the Court is the Defendants’ Motion to Dismiss filed on December 30, 2004. On February 1, 2005, the Plaintiff filed a response opposing the motion. For the following reasons, the Defendants’ motion is granted.
I. BACKGROUND
Miles Gustavson was formerly employed as an auto mechanics instructor at Standing Rock Community Grant School (“Grant School”). 1 Complaint, ¶ 8.
