January 18, 1892, the E. S. Dickie Mfg. Co., an Illinois ■corporation, made a voluntary assignment for the benefit .of creditors, naming Allen F. Moore as assignee. January 22, 1892, the County Court entered an order authorizing .and directing assignee Moore to continue the business. He did so until his successor was appointed, contracting an indebtedness of $4,892.97. At the request of the creditors, including the appellee, said Moore resigned, and George E.
