Creditor, Lincoln National Life Insurance Company (“Lincoln National”) comes before this Court requesting the dismissal of the above-captioned Chapter 11 proceeding. Lincoln National asserts that (1) the debtor has impermissibly filed this second Chapter 11 petition in bad faith and (2) the debtor’s pre-petition conduct unreasonably interfered with Lincoln National’s state law collection remedies as to constitute “cause” for relief from the automatic stay under Code § 362(d)(1);…
