The appellant, plaintiff below and hereinafter referred to as such, filed his bill of complaint against the appellee, defendant below and hereinafter so designated, alleging that he had deposited funds with the Citizens Bank & Trust Company a few days before it had closed and that at the time of such deposit the bank was hopelessly insolvent and claiming that by reason of the officers of the bank knowing of such insolvency and continuing in business and thereby representing the bank to be solvent and receiving the deposit a fraud was perpetrated upon plaintiff…
