OPINION

PAUL PRESSLER, Justice.

This is an appeal from the granting of a temporary injunction enjoining a foreclosure sale on certain property in Houston, Texas by appellant Onoray Davis Trucking Company, Inc., its agents, employees, representatives and attorney, and by Onoray Davis, Trustee under a deed of trust.

Appellant is the owner and holder of a promissory note for $25,000. This note is secured by a deed of trust on the property in question. The note and deed of trust upon which the appellants are attempting to foreclose was executed by Abbie Marshall. Abbie Marshall was a life tenant of…
