The prisoner was indicted for the murder of R. L. Thompson. He was found- guilty of manslaughter, and appeals from the judgment sentencing him to the State’s Prison for a term of two years. There was evidence that the deceased and the prisoner had a quarrel on the railroad about 2% miles from Muiyhy. Witness Maddox testified that about 2 o’clock that day Tate bought a pistol and cartridges and wrapped them up in paper.
